Big blow to Alfred Mutua as Lilian Ng’ang’a wins first round of property battle!

Machakos governor Dr.Alfred Mutua’s estranged lover Lilian Ng’ang’a is a happy woman after winning the first round of their bitter court battle over properties.

This is after the court dismissed Mutua’s plea to have the case transferred to machakos Court of law, where he claimed the dispute arose, the court insisted that the matter will be heard in Nairobi.

The Machakos legislator had argued that Nairobi court lacked territorial jurisdiction to hear and determine the case of the basis that the dispute arose in Machakos county.

The court further dismissed Mutua’s claim that it lacked jurisdiction to hear the case filed by former Machakos first lady Lilian Ng’ang’a on the basis of value of shares and stocks in question.

Mutua had also argued that, the court lacked the jurisdiction to hear and determine the matters because his estranged lover had pleaded marriage to him so court couldn’t hear the matter dealing with division of matrimonial property.

“The application is frivolous, vexations and otherwise an abuse of the court process, it’s incurably defective and lacks merit,” Mutua argued.

In the filed case by Lilian, she wants the court to issue restrictions orders against her ex-husband from going close to her house, work place or taking of her any properties pending determination of the dispute .

The case will be mentioned on November 15 when her application seeking restraining orders against Mutua will be heard.
